Disgraced NYPD cop Michael Valva and his fiancée were indicted by a Suffolk County grand jury Wednesday for their alleged hypothermia-induced murder of his 8-year-old son, one of their lawyers said.
Neither Valva, 40, or Angela Pollina, 42, appeared the in courtroom when the indictment stemming from the Jan. 17 death of Thomas Valva was handed up in Central Islip’s First District Court, according to Pollina’s lawyer Matt Tuohy.
The couple’s arraignments are expected next week, where the charges against them will be announced, Tuohy said.
Valva and Pollina were busted last Friday morning for allegedly forcing Thomas to sleep overnight in an unheated garage as the temperature plunged to just 19 degrees.
They allegedly did nothing to help as Thomas died of hypothermia. They were arrested by cops on murder charges for allegedly killing him by acting with “depraved indifference to human life.”
Tuohy said his client, Pollina, maintains her innocence and that “she is saying she is in no way the cause of the child’s death.”
The lawyer added: “This is a very, very, very emotional case,” but, “not all the evidence is out at all.”
Valva’s attorney, Austin Manghan, couldn’t immediately be reached for comment.
At Wednesday’s hearing, Manghan told the judge he will no longer represent Valva once the case is transferred to county court in Riverhead, according to Newsday.
